Terms and Conditions

Pool Barrier Inspect (part of Picwal Australia Pty Ltd ABN 26 057 415 997) it’s directors, employees or representatives are hereafter referred to as Pool Barrier Inspect. (PBI)

Nature Of Contract

PBI representative shall carry out an inspection upon request by the owner, and in accordance with the Building Act 1993 and or the Building Regulations 2018 the services in accordance with this agreement.

The property owner (Pool Owner) has agreed to pay PBI the fee for services laid out in the fee’s advertised within the main website for initial inspection and if required a reinspection.

PBI relies on the cooperation of the pool owner at the time of the inspection.

Prior to the inspection a copy of the council registration should be provided or on the day of the inspection on site, this states the standard that will be applied to the pool/spa along with the construction date.

Results of the inspection.

In many cases the pool/spa barrier meets to compliance standards, thereafter a form 23 compliance certificate will be issued as soon as possible for the pool owner to lodge with local council. (Lodgment within 30 days of certificate date).

If the barrier needs rectification works an inspection report will be generated and explained best as possible with the owner to have any issues rectified within 60 days of the report date. A reinspection with PBI can be scheduled and charged at the nominated reinspection fee within the main website.

Whilst we cannot give advice, we can suggest possible remedies for any issues or share some third-party trades to help however we do not endorse any product or company nor take responsibility for these outcomes.

Photos and Video content.

Engaging our services, you consent to PBI taking photos and video of the pool/spa barrier and property for the purpose of the inspection report and holding records at the time of inspection of the condition and working function of the barrier. These will be held on file for 10 years as a part of the legislation for records relating to the compliance/noncompliance of the barrier at that point in time.

Owners’ warranties and Indemnities

The owner warrants the accuracy and completeness of all information given to PBI when PBI is carrying out the services acts with the owner authority.

The owner shall indemnify PBI against any claims in respect of PBI acting within authority as the owner’s agent. The owner is responsible for ensuring the barrier is properly maintained.

Payments and Fees

PBI will require payment in full by the property owner using the payment method within the main body of the website prior to the inspection or on the day of the inspection.

 

Reports or certificates maybe held until payment has been completed.

Refunds can be obtained for circumstances like cancellations (before 24HRS prior to inspection) by emailing us at poolbarrierinspect@gmail.com

Owner Obligations with inspection results.

The owner will be responsible to lodge certificate with council within 30 days of the compliance certificate date.

Some councils may have electronic portals to lodge these form 23 certificates. Check your council website.

If the barrier requires correction works to be done to meet the standard required, you will have 60 days from the inspection report to have these done and a reinspection booked with PBI

 

You will not be permitted to use another pool safety inspector (building surveyor) other than PBI or it’s representative to conduct the reinspection.
